These terms govern your use of the Mnesic Coffee website and your participation in our loyalty programme. By creating an account, joining the mailing list, or earning and redeeming points, you agree to them.

01About these terms

These Terms of Service govern your use of the Mnesic Coffee website at mnesiccoffee.com and your participation in our loyalty programme.

By creating an account, joining our mailing list, using the website, earning points or redeeming rewards, you agree to these terms.

These terms form a legally binding agreement between you and:

You must be at least 16 years old to create a loyalty account. If you are under 16, a parent or guardian must register on your behalf.

Nothing in these terms limits any rights you may have under applicable consumer law, including the Consumer Rights Act 2015.

02Our services

Mnesic Coffee is a speciality coffee shop. Through our website, we may provide the ability to:

  • view information about our shop, menu and brand;
  • join our mailing list;
  • create and manage a loyalty account; and
  • earn and redeem loyalty rewards, where the programme is active.

We aim to keep the website accurate, available and secure, but we do not guarantee uninterrupted access at all times. From time to time, we may suspend or restrict access for maintenance, updates, security or operational reasons.

03Your account

If you create an account, you are responsible for keeping your login details confidential and for all activity that takes place under your account.

You agree that:

  • the information you provide is accurate and up to date;
  • you will maintain only one account per person unless we expressly permit otherwise;
  • you will not share your account with anyone else; and
  • you will notify us promptly if you believe your account has been accessed without authorisation.

You may close your account at any time by contacting us at info@mnesiccoffee.com.

We may suspend or close an account where we reasonably believe it has been used fraudulently, unlawfully or in breach of these terms. Where appropriate, we will seek to notify you first and give you an opportunity to respond.

04Loyalty programme rules

This section applies only where the loyalty programme is active. Current programme details, including rates, thresholds and available rewards, will be displayed on the relevant pages of the site.

Earning points

Points are earned at the rate published on the site at the time of purchase. Unless otherwise stated, the current rate is 10 points per £1 spent, rounded down to the nearest whole point.

To receive points for an in-store purchase, you must identify yourself as a loyalty member before the transaction is completed.

We may change the points earn rate in the future. Any such change will be notified in advance on the website. Changes will apply prospectively and will not affect points already earned.

Points:

  • have no cash value;
  • cannot be sold, exchanged or transferred; and
  • may only be redeemed in accordance with the rules of the programme.

Tiers

Membership tiers and thresholds are shown on the site.

Unless otherwise stated:

  • all new members start at Bronze;
  • Silver is reached at 500 points; and
  • Gold is reached at 1,500 points.

Redeeming points does not reduce your tier unless we expressly state otherwise.

We may update tier thresholds or benefits by giving reasonable notice on the website.

Redeeming rewards

Rewards and their points values are displayed in your account dashboard or elsewhere on the site.

When you redeem a reward:

  • the relevant points are deducted immediately;
  • a voucher or code may be generated for use in-store; and
  • the reward remains subject to availability and any stated conditions.

If a redemption cannot be honoured because it was ineligible or processed in error, we may cancel the redemption and restore the corresponding points.

Unless otherwise stated, reward vouchers expire 30 days after issue. Expired vouchers are not refundable.

Pausing or ending the programme

We reserve the right to pause, amend or withdraw the loyalty programme.

If the programme is paused, previously earned points will ordinarily remain on your account unless we state otherwise.

If the programme is permanently withdrawn, we will aim to give at least 30 days’ notice so that members can use any remaining points, unless legal, technical or operational reasons prevent us from doing so.

Fraud or misuse

If we reasonably suspect abuse of the loyalty programme, including duplicate accounts, manipulated transactions, collusion or other dishonest conduct, we may:

  • reverse points;
  • cancel rewards or vouchers;
  • suspend or terminate the account; and
  • take any other reasonable step necessary to protect the integrity of the programme.

Where appropriate, we will explain the reason for our action.

05Acceptable use

You must use the website and loyalty programme lawfully and responsibly.

You must not:

  • attempt to access restricted areas without permission;
  • interfere with the security, performance or operation of the website;
  • use bots, scripts or automated tools to create accounts, redeem rewards or access the service in an abusive way;
  • scrape, copy or reuse website content for commercial purposes without permission;
  • submit unlawful, defamatory, abusive or infringing material; or
  • transfer, sell or exploit loyalty rewards or vouchers in a way not permitted by us.

06Intellectual property

All intellectual property rights in the website, branding, logos, text, photography, design, software and related materials are owned by us or licensed to us.

You may view and use the website for personal, non-commercial purposes only. You may not copy, reproduce, distribute, modify, publish or otherwise exploit any content without our prior written consent, except where permitted by law.

07Content you provide

If you submit or share content with us, including reviews, photos, tagged social posts or similar materials, you confirm that:

  • you have the right to provide that content; and
  • the content does not infringe the rights of any third party.

By submitting such content, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, display and share it for the purposes of operating, promoting and improving our business.

You may ask us to stop using your content at any time, and we will act reasonably in response to that request.

08Liability

Nothing in these terms excludes or limits our liability where it would be unlawful to do so, including for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation; or
  • any other liability that cannot lawfully be excluded or limited.

Subject to the above, and to the fullest extent permitted by law:

  • we are not liable for indirect, incidental or consequential loss;
  • we are not liable for losses caused by events outside our reasonable control; and
  • our total liability arising out of or in connection with these terms shall be limited to the greater of £100 or the value of the points and rewards associated with your account at the time the relevant issue arose.

09Suspension and termination

You may stop using the website and close your account at any time.

We may suspend or terminate your access where you materially breach these terms, misuse the service, or where suspension is reasonably necessary for legal, technical or security reasons.

If your account is closed, your loyalty points may be forfeited unless required otherwise by law or stated by us in writing.

Personal data associated with your account will be handled in accordance with our Privacy Policy.

10Changes to these terms

We may update these Terms of Service from time to time.

Where a change materially affects your rights or how the loyalty programme operates, we will take reasonable steps to notify you in advance, including by email or by prompting you to review the updated terms when you next use your account.

Minor administrative or non-material changes may take effect immediately once published.

The current version will always show the latest Last updated date.

11Governing law

These terms are governed by the laws of England and Wales.

Any dispute arising in connection with these terms shall be subject to the non-exclusive jurisdiction of the courts of England and Wales, without affecting any rights you may have under mandatory consumer laws in the country where you live.
